DeKalb County Georgia Requires Lenders to Register Foreclosed Properties

DeKalb County Georgia in metropolitan Atlanta has passed a new ordinance requiring creditors to register foreclosed properties with the County. Connie Stokes, the commissioner who drafted the oridinace says the registry "will require financial institutions to maintain the properties and prevent blight."

DeKalb County Georgia Requires Lenders to Register Foreclosed Properties

The registry will contain the owner's name and owner's contact information. Each property registered requires payment of a $175.00 fee.

Properties and contact information will be available online to anyone in 90 days.

Commissioner Stokes, who is a real estate broker, says "This is not to be a penalty to financial institutions. This is to make sure they know they have to take care of these properties."

Have you reached the end of your economic rope? Many Atlantans have experienced loss of income and do not have the ability to make mortgage payments. Does this mean foreclosure is inevitable? Maybe not. especially if you are willing to communicate your situation with your lender.

Short Sales Offer An Alternative to Atlanta Foreclosure

When overwhelmed with unpaid bills and mortgage payments, the natural tendency is to stick your head in the sand and hope it will all go away. Not going to happen, when you finally pull your head out of the sand you will find all the bills, bill collectors, lenders and banks are standing right next to you ready to collect and make your life miserable. You do have options. You can sell your home as a short sale and have the lender reduce the amount you owe on your loan.

Short sales do require you to communicate with your lender and provide documentation of loss of income or other reason you can't pay your mortgage payment. You can;t just decide you don't want to pay the mortgage. You have to be unable to pay. And you have to provide documentation to the lender including bank statements, IRS returns etc.

Once you have contacted your lender, things will go a lot smoother when you list your home with a CDPE (Certified Distressed Property Expert) and give your bank permission to communicate with the Realtor. The bank then starts a line of communication up with the Realtor about the listing, the terms of the sale, the approved price etc. You don't have to deal with all the details. The bank and real estate agent pick it up from there.

Just making the decision to move forward with a short sale gives many home owners emotional relief. You are carrying around a lot of unnecessary baggage and anxiety because of the unpaid mortgage payments. Give your self a break and start the process of recovery. Thousands of homeowners nationwide have made the same decision and have now put them selves in a position te re establish their credit and bank balances.

The Atlanta Job market just received some bad news. Our job market is poor. Atlanta jobs are scarce.

The Atlanta Business Chronicle makes the following report:

"Georgia has the sixth-weakest state economy, according to a midyear review of state employment trends by Portfolio.com and bizjournals, the Internet arm of American City Business Journals, parent company of Atlanta Business Chronicle.

This year's study puts Nevada in 51st place, dead-last among the 50 states and the District of Columbia. California ranked 50th, followed by Florida, Michigan, Rhode Island and Georgia.

The study gives Georgia a -9.32 score for employment, pointing out the Peach State lost 74,600 jobs from 2009 to May 2010. The state now has 3,139,200 private sector jobs and a 10 percent unemployment rate." Atlanta Busines Chronicle July 28, 2010

Understanding Short Sale Transactions | A Guide to Short Sale Facts & Myths

A short sale unfortunately has become a common buzz word in the Real Estate industry. For those that have been hearing the term "short sale" and don't quite understand what it means, a short sale is a legal lender approved solution designed to assist a home owners who is financially strapped to get out from under their mortgage debt.

A short sale is negotiated through the mortgage holder of an owners home where by the mortgage holder agrees to take less than what home owner owes on the property.

A quick example of a short sale would be if a home owner owes $400,000 on their current mortgage and their home is only worth $350,000. The lender in this example would agree to take a short fall of $50,000 at closing.

In some cases the mortgage holder may completely wipe out the debt and the home owner does not have to repay the 50,000. Many lenders may require a seller to sign a note and repay the debt over a certain amount of time. Typically the debt will be reduced and the owner may receive favorable repayment terms of the short fall.

There is quite a bit to know about short sales from both a buyer's and seller's perspective. I have been successfully been completing Massachusetts short sales over the last three years. In fact (knock on wood) I have never had a short sale that did not get approved! Successfully completing a short sale is about understanding the process.

Many consumers make extremely poor choices by working with Real Estate agents that don’t have a lick of experience with getting short sales approved. Picking a good short sale Realtor is critical to your success.

The following is a number of specific topics about short sale transactions that you would want to be aware of if you are planning to either buy or sell one of these types of distressed properties.

Stop making mortgage payments during a short sale? ~ Whether or not a home owner should continue to make mortgage payments is a common question that many sellers want to know when considering a short sale. The most common answer to this question is YES, however it really depends on the lender! Click the link to understand all the considerations.

Picking the right short sale Realtor ~ Picking a Realtor to work with in a short sale is very different than a traditional transaction. You want to work with an agent that has experience successfully closing this type of transaction. Remember as a seller you could potentially be facing a foreclosure. There are many mistakes that are made by agents handling short sales. Don't get caught with your pants down!

Questions to ask a short sale listing agent ~ If you are thinking about buying a short sale there are some specific questions you can ask the listing agent to determine the probability that the short sale will be approved or not. These short sale questions will also help determine if the Realtor handling the short sale knows what they are doing!

Acceptable hardships for a short sale ~ On many occasions when doing a short sale the lender is going to require some kind of hardship on the part of the seller. Short sale hardships however, have become less rigid recently and some lenders are becoming more concerned strictkly on whether the short sale would benefit them more than a foreclosure sale.

Short sale tax consequences ~ Understanding the tax consequences in a short sale is one of the most important considerations for a home seller. Whether the short sale home was a primary residence or an investment property can have different tax implications.

Getting short sale debt released ~ Getting the debt released on a short sale is obviously a very big deal. Many Realtors that are working with short sales don't have any knowledge of how to get the debt released. A seller needs to pay particular attention to this detail as you can expect to be hearing from a collection agency without it!

When to do a short sale home inspection ~ This topic is important to understand from both a buyer's and seller's perspective. A home inspection should be done before short sale approval and NOT after. Read the article to understand why it benefits both the buyer and seller to do so.

Strategic default vs short sale ~ There are many home owners who are deciding just to walk away from their homes. Fannie Mae has started to crack down on this practice and is now penalizing borrowers from getting a mortgage for up to seven years! A perfect alternative to a strategic default is a short sale.

English Team clients have been loading their shopping carts this week with deeply discounted houses from the national bargain basement sale. Foreclosures, estate sales and fire sales have been on the "buy" list for buyers represented by The English Team this week.

Bargain Basement Sale: Are you grabbing items from the sale rack at a deep discount?

If you have ever shopped bargain basement sales at Fellinis, Macys or Richs, you know the excitement of finding a bargain priced sales item in a pile of junk on the sale table. What are the "Dog Days" of summer?

"The hottest, most sultry days of summer. In the northern hemisphere, they usually fall between early July and early September. Dog Days can also define a time period or event that is very hot or stagnant, or marked by dull lack of progress. The name comes from the ancient belief that Sirius, also called the Dog Star, was somehow responsible for the hot weather." Wikipedia

I am starting to feel the real estate market has hit it's own dog days. Stagnant, dull and lack of progress pretty well define what's happening right now for most of the Atlanta market. We are getting some good showings from motivated, pre-qualified buyers who have to move because of a job relocation etc. But most of the buyers are staying home and move up buyers have pretty much shut it down for the summer.

Investors are starting to kick tires as the values are amazing. I faithfully read John Adams column in the AJC and he is spot on in his analysis of the Atlanta market. We are at rock bottom and prices will not go much, if any, lower.

So buyers, get out there and buy the real estate deal of a lifetime. I promise you will find motivated sellers. They would start drooling and barking if they could get some interest from a buyer in the dog days of summer. Buyers will get some amazing deals.

English Family attends Mary Jane Stacy and James Brent Wedding

Wow, we had an amazing weekend. Family friend Mary Jane Stacy married James Brent Saturday July 17th. Our oldest daughter Caroline was a bridesmaid and our daughters Ellie and Hannah were program attendants.

The wedding was held at our home church, First Presbyterian Church of Atlanta. Mary Jane wore a to die for wedding dress and veil. The groomsmen wore seersucker suits and the bridesmaids wore custom maid hot pink dresses.

The reception was held in a building overlooking Piedmont Park and a rocking band enlivened the evening.

Caroline's friend from Princeton, Alex, joined us for the weekend. By Sunday evening we were all exhausted.

James and Mary Jane Brent are in Cancun Mexico for their honeymoon. Our friends Tom and Mary Susan Stacy, parents of the bride, are recuperating!!!!

Fannie Mae Penalizing Strategic Defaulters

Fannie Mae says it will start penalizing "strategic defaulters" who walk away from Fannie Mae insured loans. Strategic defaulters are borrowers who walk away from mortgages they can afford to pay.

"Starting in October, Fannie Mae says, strategic defaulters will be disqualified for new Fannie Mae-
backed loans for seven years after their foreclosures. Fannie also says it will go to court
where it can to recoup outstanding mortgage debt from borrowers who strategically default.

Under a bill that's passed the House and awaits Senate action, the Federal Housing Administration
would be barred from insuring mortgages for those who previously ditched a mortgage they had the
ability to pay. Get-tough policies are forming at the same time that about a quarter of mortgage borrowers owe more than their homes are worth. Fannie Mae buys about 40% of all mortgages and packages them for resale to investors. The FHA insures about 30% of home mortgages." USA Today

Apparently Fannie Mae will look to see if defaulters still have access to credit and are current on other debts. I do not see how this will work as a practical matter. But then again, the yearly IRS return is so complicated and non intuitive, we may all be in for a bunch of bureaucratic paperwork and reporting that will make this one more obstacle for home ownership.

This bill has passed the US House but has not passed the Senate so hopefully there will be significant changes to the bill including an incentive for Short Sales that actually works. We need to clear the inventory of bad loans but we also need to use some common sense in our public policy.

Mark and Mary Kay Woodworth Home Featured in AJC Private Quarters

Congratulations to Mark and Mary Kay Woodworth whose home on Kiggslciff Way was recently featured in the Atlanta Journal and Constitutions Private Quarters. Go here to see the complete article and photo spread.

Mark and Mary Kay are English Team clients and it was my pleasure to represent them in the purchase of their new home. Mark McKrow, an Earthcraft Builder, constructed the home and came back to finish the basement after the Woodworths moved in.

In an interesting turn of events, Mark and Mary Kay live on the lot where I grew up. My childhood home was torn down to create two building lots on Kingscliff lake and the Woodworths live on one of the new lots.

In an even more unique turn of events, my nephew and his wife (Ben and Kristen Bryant) purchased the Woodworths old home. This home is mentioned in the AJC article as Mary Kay discusses the decision to renovate the old home or purchase a new one.

Congrats to Mark and Mary Kay. There is not a nicer family anywhere.
